Carriage of Goods by Sea (Hamburg Rules)
Any action relating to carriage of goods under the Convention is time-barred if judicial or arbitral proceedings have not been instituted within a period of two years.
IOPC Fund (International Oil Pollution Compensation Funds)
Claims against the IOPC Fund must be brought before a competent court within three years of the incident that caused the pollution.
Bunker Oil Pollution Convention
A six- year absolute time bar from the time of the incident and a three- year bar from the time of the damage is prescribed.
2010 HNS Convention (Hazardous and Noxious Substances Convention)
A three- year time bar is applicable for claims against the owner or the insurer. In respect of claims against the owner, the starting date for the running of the limitation period is the moment the claimant knows or should reasonably have known of the damage and the identity of the owner.
An additional time bar of ten years from the date of the incident is also provided for claims against the HNS Fund to cover cases where the starting date of the time bar period is delayed and is not caught by Article 37.1 or 37.2 because, for example, the damage is identified late or the identity of the owner is not revealed.
HNS Fund
As with actions against the owner or its insurer a three- year time bar is applicable in respect of claims against the HNS Fund.
Hague-Visby Rules
Cargo claim time bars are typically one year from the date of delivery or expected delivery date, as per the Hague/Hague-Visby Rules.
